Yes, as I told you before, with Supreme Court Justice David Souter retiring, because he has become fed up with the White House, we still do not know what that means, the big news making it's way around the Morning News Shows yesterday was Senators speculating who is Obama going to choose.
Some on the Right are complaining about Obama's wording in talking about this. They say that him talking about them being able to connect with average Americans, understanding "Justice isn't about some abstract legal theory or footnotes in a case book," and that he wants them to have a "quality of empathy" that this means he is setting the tone for a FAR LEFT Liberal activist Judge. One that may or may not even have experience.
Of course he is. He actually said this.
"I will seek someone who understands that justice isn't about some abstract legal theory or footnotes in a case book. It is also about how our laws affect the daily realities of peoples' lives, whether they can make a living, care for their families, whether they feel safe in their homes and welcome in their own nation."
"I view that quality of empathy, of understanding and identifying with peoples' hopes and struggles as an essential ingredient for arriving at just decisions and outcomes."
So what does that say to you? To me, I share their concerns. There has been much talk about a Woman or a Minority. There is speculation that he is looking at Judge Sonia Sotomayor of the 2nd U.S. Circuit Court of Appeals in NY. Remember her? Sotomayer was on the panel that rejected a new trial for the former radical activist, Judith Clark who is imprisoned for being the getaway driver in a 1981 Rockland County armored-truck robbery. The incident left three people dead, including two police officers.
"See? She is not a Radical. She did not advocate from the bench. She would make a great Judge. She was even appointed by President George H W Bush."
However, The Wall Street Journal called her a "liberal." The Free Congress Foundation called her a "Judicial Activist." Amnesty groups pushed for her confirmation in 98. She was confirmed on October 2, 1998 in a 67-29 vote, and she received her Commission on October 7.
She is a big Amnesty Advocate and a big Anti-Life Advocate. {Pro-Choice} So she fits the Obama Agenda. Some other names being bantered around? Jennifer Granholm who is the Michigan Governor, Deval Patrick who is a friend of Obama and the Massachusetts Governor, and Cass Sunstein who is a University of Chicago Law Professor, and an Obama friend. None of which are Judges. This is want some Democrats want.
"I would like to see more people from outside the judicial monastery, somebody who's had some real-life experience, not just as a judge," Leahy, D-Vt., said on ABC's "This Week."
Sen. Arlen Specter of Pennsylvania, Said this
"It would be good to get people who know something besides wearing a black robe," on NBC's "Meet the Press."
The general consensus is pretty much set though, it will be a Liberal. Why would you think it wouldn't be. It will be someone that will help Obama further his agendas. Souter showed himself to be more Liberal than not, so I do not think that this one pick of Obama, will really change the court that much, but it may be a sign of what is to come in the future.
