Sotomayor's Spin on Racist Comment Forming

Are you buying? They REALLY want this idiot confirmed. They are attempting to spin her Racist comment and they are using her "record" to back up their allegations that she is not a Racist. There is a BIG problem with that though.

WASHINGTON -- When Judge Sonia Sotomayor faces the Senate Judiciary Committee next week, she will finally get to explain before the cameras her comment that a "wise Latina" can often reach a better conclusion than a white man. That response could help determine whether her confirmation is smooth or rocky.

Despite the furor surrounding the remark -- which she made at a law school in 2001, among other occasions -- Judge Sotomayor hasn't been able to address it publicly since her nomination, because nominees typically don't speak out before their hearings.

She could if she wanted to. But she is waiting for the spin.

However, she did discuss it privately when she made the rounds of senators following her nomination. Based on those discussions, she is likely to say that her judicial record shows no hint of the bias or activism that critics see in the remark. She also is expected to defend the importance of diversity on the bench, while perhaps offering a nod to critics by calling her choice of words imperfect.

One BIG example is the Firefighter case that just got overturned.

"I asked her that question...and she was very direct," said Sen. Kirsten Gillibrand (D., N.Y.). "She just said, '[Latina identity] is something that informs my experience, but I'm always going to look to judicial precedent, I'm always going to follow the rule of law.'"

Problem, she has been OVERTURNED 65 percent of the time. Apparently she is on the WRONG side of the "rule of law." 65 percent of the time.

Manuel Miranda, a former aide to Republicans on the Senate Judiciary Committee who is working against Judge Sotomayor's confirmation, said that "the whole race-bias issue" suggested by the remark will probably be the liveliest part of the hearing. "I think that's explosive, I think that's worthwhile, I think that's entertaining," Mr. Miranda said. "Then it becomes pretty boring."

Judge Sotomayor made the now-famous comment in a speech at the University of California, Berkeley, in which she noted that even great judges like Oliver Wendell Holmes had voted to uphold racial and sex discrimination.

"I would hope that a wise Latina woman, with the richness of her experiences, would more often than not reach a better conclusion than a white male who hasn't lived that life," she said.

The White House initially argued that, as spokesman Robert Gibbs put it, "She'd say her word choice in 2001 was poor." But it soon emerged that Judge Sotomayor had used similar language on several other occasions.

Because she is a RACIST!

Sen. Charles Schumer (D., N.Y.), a strong supporter of Judge Sotomayor, said she pointed out to him that several sentences later in the same speech, she observed that many white men had issued great opinions, including Brown v. Board of Education, the 1954 case outlawing segregation in public schools.

{Laughing} So because she gave "Some White Men" a prop, she is not Racist?

Mr. Schumer made the argument that is likely to be Judge Sotomayor's chief response -- that her 17-year judicial record, including hundreds of rulings, shows no evidence of unfairness or tilting the scales in favor of minority groups, whatever she may have said in speeches.

"Paraphrasing Joe Friday, 'Just look at the record, folks,'" Mr. Schumer said.

Cases that clearly show Racist Bias and 65 percent turnover rate. OK. Let's look at that.

But many Republicans consider the comment biased on its face. Judge Sotomayor has told Republican senators her wording was "inadvertent" and "inartful," but they will press her hard at the hearing for a persuasive disavowal.

"I do think that based on her speeches and writings, that it will be essential that she convincingly assert that she will be impartial," said Sen. Jeff Sessions (R., Ala.), the Judiciary Committee's top Republican.

Democrats are certain to argue, if Judge Sotomayor doesn't, that conservative Supreme Court Justices Antonin Scalia and Samuel Alito cited their Italian-American backgrounds during their own confirmation hearings, to suggest their sensitivity to discrimination and sympathy for immigrants.

"Just based on her record, she is clearly not, as her opponents are saying, an activist," Ms. Gillibrand said. "She is someone who follows precedent, follows the rule of law and is very judicial in temperament."

But that really is NOT what her record shows folks. She is who and what she is. She is NOT the right person for the job. No matter how much they try to spin it.

Happy Hump Day. For those of you who are true OPNers, Judge Sonia Sotomayor is no surprise. I told you back on May 5, 2009, that she fits the Obama Agenda. Democrats Want Lackey Judge

"There is speculation that he is looking at Judge Sonia Sotomayor of the 2nd U.S. Circuit Court of Appeals in NY. Remember her? Sotomayer was on the panel that rejected a new trial for the former radical activist, Judith Clark who is imprisoned for being the getaway driver in a 1981 Rockland County armored-truck robbery. The incident left three people dead, including two police officers.

"See? She is not a Radical. She did not advocate from the bench. She would make a great Judge. She was even appointed by President George H W Bush."

However, The Wall Street Journal called her a "liberal." The Free Congress Foundation called her a "Judicial Activist." Amnesty groups pushed for her confirmation in 98. She was confirmed on October 2, 1998 in a 67-29 vote, and she received her Commission on October 7.

She is a big Amnesty Advocate and a big Anti-Life Advocate. {Pro-Choice} So she fits the Obama Agenda...."

Obama did pick her yesterday. This is his choice for the highest court in the land. According to some news out there, she found her inspiration reading Nancy Drew. Uh, OK. She had a hard life. OK. She is Hispanic. You don't say. She is a Woman. Really? "A Victory for Latina Moms?" Of course the Left is calling this "Brilliant, Historic, Wise."

It's called Identity Politics. It is also called putting someone up, that RACE can be used to defend her, leaving facts aside, to get a lackey in place to further an agenda. If you dare say anything against her RECORD. Her own STATEMENTS. Her own ACTIONS. Then YOU are a Racists. That is how Obama got elected. This is how Sotomayor will be confirmed. But facts are facts.

Even the New York Times said this yesterday.

Judge Sotomayor "has issued no major decisions concerning abortion, the death penalty, gay rights or national security. In cases involving criminal defendants, employment discrimination and free speech, her rulings are more liberal than not."

It is clear who she is and where she stands. In 2001 when delivering the Judge Mario G. Olmos Law and Cultural Diversity Lecture at the University of California-Berkeley Law School, Sotomayor said this.

Some say this is a very controversial and even offensive statement. But that is what Obama TOLD you he was looking for. Not someone with experience in the Law. Not someone that believes in the Constitution, he doesn't, but someone that will rule by life experiences. Empathy.

Yes, with the MMD {Mainstream Media Drones} simply keep hammering that this is brilliant and you are a Racist if you disagree, and of course the fact she has a lot of friends on the Left that have the power to rush her into the Seat, this is a done deal. Elections have consequences. She can not be stopped. Look for Amnesty, Prop 8 to be visited, and of course Abortion, to be on the docket once she is in place. Constitutional Challenges? I doubt you would like the outcome of those. No folks. Another blow to Freedom and Democracy. Another Radical to be put in place.

The only way you can slow any of this down at all, is to get ready, get educated on what is happening right in front of you, and go VOTE when the time comes. Do it before your vote no longer matters.

Yes, as I told you before, with Supreme Court Justice David Souter retiring, because he has become fed up with the White House, we still do not know what that means, the big news making it's way around the Morning News Shows yesterday was Senators speculating who is Obama going to choose.

Some on the Right are complaining about Obama's wording in talking about this. They say that him talking about them being able to connect with average Americans, understanding "Justice isn't about some abstract legal theory or footnotes in a case book," and that he wants them to have a "quality of empathy" that this means he is setting the tone for a FAR LEFT Liberal activist Judge. One that may or may not even have experience.

Of course he is. He actually said this.

"I will seek someone who understands that justice isn't about some abstract legal theory or footnotes in a case book. It is also about how our laws affect the daily realities of peoples' lives, whether they can make a living, care for their families, whether they feel safe in their homes and welcome in their own nation."

"I view that quality of empathy, of understanding and identifying with peoples' hopes and struggles as an essential ingredient for arriving at just decisions and outcomes."

So what does that say to you? To me, I share their concerns. There has been much talk about a Woman or a Minority. Jennifer Granholm who is the Michigan Governor, Deval Patrick who is a friend of Obama and the Massachusetts Governor, and Cass Sunstein who is a University of Chicago Law Professor, and an Obama friend. None of which are Judges. This is want some Democrats want.

"I would like to see more people from outside the judicial monastery, somebody who's had some real-life experience, not just as a judge," Leahy, D-Vt., said on ABC's "This Week."

Sen. Arlen Specter of Pennsylvania, Said this

"It would be good to get people who know something besides wearing a black robe," on NBC's "Meet the Press."

The general consensus is pretty much set though, it will be a Liberal. Why would you think it wouldn't be. It will be someone that will help Obama further his agendas. Souter showed himself to be more Liberal than not, so I do not think that this one pick of Obama, will really change the court that much, but it may be a sign of what is to come in the future.
